Welcome to UPer Weed. These Terms and Conditions (the "Terms") govern your access to and use of the website uperweedca.com (the "Website") and the products and services offered by UPer Weed ("we," "us," or "our"), an Indigenous-owned cannabis delivery business based in Ottawa, Ontario.
By accessing the Website, placing an order, or using any service we provide, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Website or our services.
1. Eligibility and Age Verification
1.1 Minimum Age Requirement
You must meet the legal minimum age for cannabis purchase in your province or territory of residence to use our Website or place an order. The minimum age is:
- 19 years of age in Ontario, British Columbia, Saskatchewan, Manitoba, New Brunswick, Nova Scotia, Prince Edward Island, Newfoundland and Labrador, Yukon, Northwest Territories, and Nunavut.
- 18 years of age in Quebec and Alberta.
1.2 Verification
By accessing the Website or placing an order, you represent and warrant that you are of legal age in your jurisdiction and that all information you provide is true and accurate. We reserve the right to request valid government-issued photo identification at any point in the order or delivery process. Failure to provide valid identification when requested will result in order cancellation and may result in account suspension.
1.3 Responsibility
It is your responsibility to ensure that your purchase, possession, and consumption of cannabis products comply with the laws of your province or territory. We do not sell to, or knowingly deliver to, anyone under the legal minimum age, and we cooperate fully with law enforcement in cases of suspected underage purchase attempts.
2. About UPer Weed
UPer Weed is an Indigenous-owned cannabis delivery business operating out of Ottawa, Ontario, with same-day delivery service to Ottawa, Gatineau, Cornwall, and surrounding areas, and mail-order shipping available across Canada. Our operations are conducted in accordance with our rights as an Indigenous business, and we are committed to providing high-quality cannabis products to adult consumers in a respectful, professional, and discreet manner.
All products listed on the Website are intended for adult use only in jurisdictions where the purchase and consumption of cannabis is permitted.
3. Orders and Payment
3.1 Order Placement
Orders may be placed through the Website at any time. By submitting an order, you make an offer to purchase the products listed in your order at the prices listed on the Website. We reserve the right to accept or decline any order at our sole discretion, including for reasons of product availability, inability to verify age, suspected fraudulent activity, or shipping to a location where we do not deliver.
3.2 Payment Methods
We accept the following payment methods:
- Interac e-Transfer: Available for all orders (same-day delivery and mail-order).
- Cash on delivery: Available exclusively for same-day delivery orders within our local delivery area.
Payment instructions for e-Transfer are provided on the order confirmation page and in the order confirmation email. All e-Transfer payments must include the order number in the memo field to ensure correct allocation. We do not currently accept credit cards, debit cards, or cryptocurrency.
3.3 Payment Window and Order Status
All orders are placed on "On Hold" status upon submission and remain on hold until payment is received and verified. Orders not paid within 48 hours of submission are automatically cancelled, and customers are notified by email. Once payment is verified, your order moves to "Processing" status and is dispatched according to your selected delivery method.
3.4 Pricing
All prices are listed in Canadian dollars (CAD). Prices do not include applicable taxes unless otherwise stated. We reserve the right to modify product prices at any time without notice, but any price change will not affect orders for which payment has already been received.
3.5 Order Accuracy
You are responsible for ensuring the accuracy of all order information, including the shipping address, contact phone number, and product selections. We are not responsible for delays or non-delivery resulting from incorrect information you provide.
4. Delivery and Shipping
4.1 Same-Day Delivery
Same-day delivery is available within our local delivery zone covering Ottawa, Gatineau, Cornwall, and surrounding postal codes (full coverage map available on our Website). Same-day delivery is offered at a flat rate of $10 on orders under $100, with free same-day delivery on orders of $100 or more. Standard same-day delivery times are 60 to 90 minutes for retail orders during operating hours (9:00 AM to 11:00 PM, seven days a week). Wholesale orders may require additional preparation time of 1 to 4 hours.
4.2 Mail-Order Shipping
Mail-order shipping is available Canada-wide via Canada Post Xpresspost. Mail-order shipping is offered at a flat rate of $30 on orders under $150, with free mail-order shipping on orders of $150 or more. Standard mail-order delivery times are 1 to 3 business days to most Canadian destinations, though delivery times to rural and remote areas, including Yukon, Northwest Territories, and Nunavut, may be longer.
4.3 Risk of Loss
For same-day delivery orders, risk of loss passes to you upon successful delivery to the address you provided. For mail-order shipments, once your package is tendered to Canada Post and you receive a tracking number, the package is in transit and we accept no responsibility for loss, damage, theft, or delay caused by the carrier. We strongly recommend providing a secure delivery address where someone is available to receive the package.
4.4 Yukon, Northwest Territories, and Nunavut
Mail-order shipments to Yukon, Northwest Territories, and Nunavut are accepted, however delivery times in these regions are not guaranteed by Canada Post and may be significantly longer than mainland delivery. UPer Weed assumes no liability for delays, weather-related disruptions, or non-delivery to these regions once the package has been tendered to the carrier.
4.5 Failed Delivery
If a same-day delivery cannot be completed because no one of legal age is available to receive the order, the delivery attempt may be rescheduled or the order may be returned and refunded less applicable delivery fees. If a mail-order package is returned to us by Canada Post as undeliverable, we will contact you to arrange reshipment (at your expense) or a refund less the original shipping cost.
5. Products
5.1 Product Descriptions
We strive to provide accurate product descriptions, images, and specifications. However, we do not warrant that product descriptions, photographs, prices, or other content on the Website is complete, accurate, current, or error-free. Cannabis is a natural product, and variations in appearance, aroma, and effect are normal. THC and CBD percentages listed are based on laboratory testing of representative samples and individual experiences may vary.
5.2 Product Availability
All products are subject to availability. We reserve the right to limit the quantity of any product purchased, to discontinue products at any time, and to refuse or cancel any order in whole or in part for any reason.
5.3 Health Disclaimer
Cannabis products may have psychoactive effects and may impair your ability to drive, operate machinery, or perform tasks requiring focus. Cannabis is not recommended for pregnant or breastfeeding individuals, individuals with a history of cardiac issues, individuals with a personal or family history of psychosis, or individuals taking certain prescription medications. The information provided on the Website is not medical advice. Consult a qualified healthcare professional before using cannabis for therapeutic purposes.
6. Returns, Refunds, and Cancellations
6.1 General Policy
Due to the nature of cannabis products and applicable health and safety regulations, all sales are final. We do not accept returns of cannabis products once they have left our facility, unless the product is materially defective, damaged in transit, or substantially different from what was ordered.
6.2 Defective or Damaged Products
If you receive a product that is materially defective, damaged in transit, or substantially different from what you ordered, you must contact us within 48 hours of delivery, providing photographs and a description of the issue. We will, at our discretion, offer a replacement, store credit, or refund. Issues reported more than 48 hours after delivery may not be eligible for resolution.
6.3 Order Cancellation
You may cancel an unpaid order at any time by contacting us at the contact details provided in Section 14. Once payment has been received and your order has been moved to "Processing" status, the order is being prepared for dispatch and cancellation may not be possible. Orders that have been dispatched cannot be cancelled.
6.4 Refunds
Refunds, where granted, are issued via the original payment method (Interac e-Transfer) within 5 to 10 business days of approval. Processing times for the refund to appear in your account depend on your financial institution.
7. Acceptable Use of the Website
You agree not to use the Website for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Website. Specifically, you agree not to:
- Use the Website if you are under the legal minimum age in your jurisdiction.
- Place orders on behalf of, or with the intent to redistribute to, individuals under the legal minimum age.
- Resell, distribute, or commercially exploit products purchased from us without our express written consent.
- Provide false, misleading, or fraudulent information when placing orders or creating accounts.
- Use any automated system (including bots, scrapers, or crawlers) to access the Website, except for publicly available search engine crawlers.

10. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will UPer Weed, its owners, employees, contractors, suppliers, or affiliates be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or any other intangible losses, arising out of or in connection with:
- Your use of or inability to use the Website or our services.
- Any conduct or content of any third party on the Website.
- Any products purchased through the Website.
- Unauthorized access to or alteration of your transmissions or data.
Our total cumulative liability to you for any claim arising out of or relating to these Terms, the Website, or your purchase of products from us, regardless of the form of action, is limited to the amount you paid to us for the specific order giving rise to the claim, or one hundred dollars (CAD $100), whichever is greater.

13.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.
13.2 Jurisdiction
Any dispute arising out of or relating to these Terms, the Website, or your use of our services will be resolved exclusively in the courts of the Province of Ontario, and you irrevocably consent to the personal jurisdiction and venue of those courts.
13.3 Informal Resolution
Before initiating any formal legal proceedings, you agree to first contact us in writing at the contact information provided in Section 14 and make a good-faith effort to resolve the dispute informally for a period of at least 30 days.

16. Severability and Entire Agreement
16.1 Severability
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.
16.2 Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and UPer Weed regarding the Website and our services, and supersede all prior and contemporaneous agreements, communications, and proposals, whether oral or written, relating to such subject matter.
